Prior to the enactment of the Real Estate (Regulation and Development) Act 2016, home buyers in Delhi-NCR, Noida, and Gurugram were routinely billed on opaque 'Super Built-Up Areas' featuring loading factors of 35% to 45%. RERA mandated standardized Carpet Area definitions nationwide. ### 1. Statutory Definition of RERA Carpet Area Under Section 2(k) of RERA 2016: > *"Carpet area means the net usable floor area of an apartment, excluding the area covered by external walls, areas under service shafts, exclusive balcony or verandah area, and exclusive open terrace area, but includes the area covered by the internal partition walls of the apartment."* ### 2. The Common Area Loading Myth Builders previously charged buyers for clubhouses, lift shafts, swimming pools, and emergency staircases by inflating super built-up measurements. Under current statutory rules: * Quoted per-square-foot prices must strictly correspond to **RERA Carpet Area**. * Exclusive balconies and verandahs must be priced and itemized separately in builder-buyer agreements. ### 3. Penalty for Carpet Area Variation If during possession hand-over the actual carpet area decreases by more than statutory thresholds, the promoter must refund the excess consideration with prescribed SBI Marginal Cost of Funds Based Lending Rate (MCLR) + 2% interest.
